DGMS Requirements for Overseas Manufacturers – Indian Agent, Authorization & Compliance | DGMS Notes

🌍 DGMS Requirements for Overseas Manufacturers – Indian Agent, Authorization & Compliance

India imports a large volume of mining equipment—especially Flameproof, IS, communication, automation, BEV, ventilation & safety devices—from foreign manufacturers. To ensure safety and accountability, the DGMS Approval Policy (Second Revision 2016) makes it compulsory that ALL overseas manufacturers follow specific rules and appoint an Indian Authorized Representative (IAR). This blog explains complete DGMS requirements for foreign manufacturers according to OME format.

🔹 1. Why Does DGMS Regulate Foreign Manufacturers?

 Because foreign equipment affects:
  • Explosion protection in underground mines
  • Electrical safety
  • Gas detection accuracy
  • Worker safety & rescue equipment reliability
  • Standardization & compliance with Indian Laws
DGMS ensures:

✔ Equipment meets Indian standards
✔ Service & spares are available in India
✔ Accountability exists for failures
✔ Proper testing is done in India

🔹 2. Mandatory Requirement: Indian Authorized Representative (IAR)

Every foreign manufacturer must appoint an Indian Authorized Representative under the DGMS policy. The IAR must be:
  • A legally registered Indian company

✔ C. Safety & Performance Reporting

IAR must report:
  • Product complaints
  • Failure reports
  • Field performance
  • Accidents & hazards
✔ D. Representation During DGMS Audit

  • Technical clarifications
  • Indian testing compliance
✔ E. Warranty & Product Liability IAR is accountable for:
  • Product failure
  • Replacement
  • Safety defects
  • Non-compliance

🔹 4. Authorization Letter Requirements Foreign manufacturer must issue an Authorization Letter to IAR which includes:
  • Name of company
  • Country of origin
  • Description of product(s)
  • Responsibility delegation
  • Commitment for service in India
  • Legal authorization to act on their behalf
  • Warranty obligations
The letter must be:
  • On company letterhead
  • Signed by authorized signatory
  • Notarized
  • Submitted every time approval is renewed

🔹 5. Documents Required from Overseas Manufacturers

Foreign manufacturers must submit:
  • ISO 9001 QMS certificate
  • IECEx or ATEX Ex certificates
  • QAR/QAN
  • Factory QC system documents
  • Material test certificates
  • Electrical & mechanical schematics
  • Flameproof drawings
  • Bill of materials
  • Calibration certificates

🔹 6. DGMS Testing Requirements for Imported Equipment

Imported items must undergo Indian testing, even if approved internationally. FLP Equipment
  • Explosion-proof test
  • Temperature test
  • Flamepath measurement
  • Pressure test
IS Equipment
  • Spark ignition test
  • Short-circuit safety
  • Electrical safety
Electrical Equipment
  • HV test
  • Insulation
  • IP rating
Testing done at:
  • CIMFR
  • ETDC / ERTL
  • CPRI

🔹 7. Overseas Factory Audit (Where Applicable)

 DGMS may conduct:
  • Remote audit
  • Online audit
  • Third-party audit
  • Certificate verification
  • Inspection of production line
Audit ensures:
  • No fake certifications
  • Proper QMS followed
  • Traceability maintained

🔹 8. Renewal Procedure for Overseas Manufacturers

Foreign manufacturers must re-submit:
  • Updated IECEx/ATEX certificates
  • QAR/QAN renewal
  • Performance reports
  • Updated authorization letter
  • Compliance statement

🔹 9. Grounds for Rejection / Suspension for Overseas Products

DGMS may suspend or withdraw approval if:
  • Fake certificates detected
  • IAR fails to provide service
  • Product causes accident
  • Performance unsatisfactory
  • Factory audit fails
  • Unauthorized design modifications

🔹 10. Key Differences: Indian vs. Overseas Manufacturer Requirements
Requirement Indian Manufacturer Overseas Manufacturer
ISO 9001 Mandatory Mandatory
QAR/QAN Mandatory Mandatory
Indian testing Required Required
Factory audit In-person Remote/limited onsite
IAR appointment Not required Mandatory
